By accessing or using Gently Told ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

The Service is provided by Gently Told ("Company", "we", "us", or "our"), operated from New Zealand.

These Terms apply to all visitors, users, and others who access or use the Service.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use Gently Told.

The Service is designed to be used by parents/guardians on behalf of their children. Children should not operate accounts directly.

When you create an account, you must provide accurate and complete information. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Ensuring children access age-appropriate content only
• Reviewing and approving all stories before children access them

Gently Told provides:

• AI-generated personalised audio stories for children ages 3–7
• Story customisation based on child profiles and preferences
• Parent review and approval workflow for all content
• Optional integration with Yoto audio players
• Story library and playback functionality

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

Free Story

New users receive one free story credit. Free credits have no cash value.

Story Credits

We sell packs of story credits. Each credit creates one story. There is no subscription.

• 50 story credits for NZD $24.99

Payments

Payment is processed securely through Stripe. Prices are in NZD unless otherwise specified.

Refunds

We offer a 14-day money-back guarantee for your first credit pack purchase. Contact us for refund requests.

Your Content

You retain ownership of content you provide (story ideas, child profile information). You grant us a limited license to use this content solely to provide the Service to you.

Generated Stories

Stories generated by our AI become your property. You may use, share, and distribute stories created for your family for personal, non-commercial purposes.

Our Content

The Service itself, including software, design, logos, and documentation, remains our property and is protected by intellectual property laws.

To the maximum extent permitted by applicable law, in no event shall Gently Told, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability for all claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or NZD $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless Gently Told and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of and access to the Service
• Your violation of these Terms
• Your violation of any third party rights
• Content you provide to the Service

We may terminate or suspend your account immediately, without prior notice, if we reasonably believe:

• You have violated these Terms
• You have engaged in fraudulent activity
• Continued use poses a risk to the Service or other users

You may terminate your account at any time by contacting us or using the account deletion feature in Settings. Upon termination, your right to use the Service ceases immediately.

We reserve the right to modify or replace these Terms at any time. For material changes, we will provide at least 30 days' notice before new terms take effect.

What constitutes a "material change" will be determined at our reasonable discretion.

By continuing to use the Service after changes become effective, you agree to be bound by the revised Terms.

These Terms shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand.

For users in other jurisdictions, nothing in these Terms affects your statutory rights under applicable local law.
